In order to further strengthen the supervision of the EU market environment and protect the health and safety of EU consumers, the EU Parliament and Council issued the EU Market Supervision Regulation (EU) 2019/1020 on June 20, 2019. The regulations will come into effect on July 16, 2021.
The new regulations require that products with the CE mark need to have a person in the European Union as the product compliance contact ("person in charge"). If the goods you sell carry the CE mark and are manufactured outside the European Union, you need to ensure by July 16, 2021:
1. Such goods have a responsible person in the EU;
2. Your CE marked goods are affixed with the contact information of the person in charge.
This type of label can be affixed to the product, product packaging, package or accompanying documents
Summary of FAQs
01 What is Oudi?
The European Authorised Representative (European Authorised Representative) refers to a natural or legal person explicitly designated by a manufacturer located outside the EEA (including EU and EFTA) in the European Economic Area. The natural or legal person can represent the manufacturer outside the EEA to perform the specific duties required by the relevant EU directives and laws for the manufacturer.
02 Which sellers need an EU representative?
In general, products sold with the CE mark and manufactured outside the EU require an EU representative. Common goods include toys, electronics, personal protective equipment, machinery, construction goods, gas equipment, leisure and private boats, pressure vessels, and measuring equipment. Except for medical equipment, civil explosives, and certain elevators and ropeway installations, all products with the CE mark are subject to this regulation.
The new EU product safety regulations "EU Market Supervision Regulation 2019/1020" will take effect on July 16, 2021, and major overseas e-commerce platforms will assume more important joint and several responsibility for product safety compliance. For most sellers such as Amazon/eBay/ AliExpress in China, they all need to find Oudi. In order to give sellers more buffer preparation time, major platforms have been sending out platform reminders about product safety and compliance to sellers one after another since March, requesting them to upload CE certification qualification information before the deadline. Submit the EU responsible person's information, indicating that the products on the shelves comply with the relevant EU laws and regulations.
There are also sellers who have encountered that their products are not CE marked, and they need to upload European generation information after receiving the email. Our company recommends to find an European generation for the sake of insurance.
03 Responsibilities of EU Authorized Representatives
1. As the authorized representative designated by the manufacturer, it is responsible for contacting the regulatory agencies of various countries within the European Union, and assisting in the accident report, notification, recall, etc. of the product through its EU authorized representative/EU authorized agent;
2. Keep the manufacturer's technical documents, and when the regulatory agency raises questions, contact the manufacturer, reply and communicate;
3. The name and address of the manufacturer’s EU authorized representative/EU authorized agent are printed on the packaging, label and instruction manual of the products imported from outside the EU.
04 Risks that sellers who do not use EU authorized representatives may face
After July 16, 2021, if the seller sells products with the CE mark in the EU but does not display the information of the person in charge of EU compliance, the product will be deemed illegal and the product link will be forced to be removed. If you still try to ship to the EU, you may face the following situations:
1. If the goods with the CE mark are exported to the EU customs, and the EU customs spot checks that there is no European generation information, the goods will be detained;
2. If the platform sends an email requesting the information of Oudi and cannot provide it, the product will be directly removed from the shelf;
3. Sellers who have not provided the information of Euro and British generations on July 16 will face the prohibition of warehousing or relocation of their products.
05 How can I tell if I need to register?
1. EEA sales in Europe (including EU and EFTA) require European generation, while sales in the UK require British generation;
2. The products sold are within the scope of CE and UKCA certification;
3. European generation-the product manufacturer is outside the EU; the British generation-the product manufacturer is outside the UK.
Reminder:
Now, there are only more than 60 days left until July 16 as stipulated by Amazon. Sellers who have not yet registered for Euro-Dynamics should hurry up to avoid operating losses due to platform spot checks.
In addition, as the effective date of the regulations approaches, there may be push registrations in the later period. In order not to affect the registration time limit, sellers are advised to arrange as early as possible.
